Child Birth Injury Cases
In child birth injury cases, medical negligence may be the cause of the birth injury, or may contribute to the severity of the birth injury or the permanency of the birth injury.
Birth injuries can occur from the following types of medical negligence:
- A failure to anticipate birth complications, such as with the delivery of a larger baby or where there are health complications of the Mother;
- A failure to properly respond to bleeding;
- A failure to observe umbilical cord entrapment or respond to umbilical cord entrapment;
- A failure to respond to fetal distress (such as irregularities in the fetal heartbeat);
- A failure or delay in performing a Cesarean Section or C-Section (where the baby is removed surgically through the abdomen) when medically necessary;
- A misuse of forceps or a vacuum extractor during the delivery of the baby;
- A failure to properly administer Oxytocin or Pitocin (a hormone used to stimulate contractions and induce or speed up labor).
Additionally, injuries can occur to a baby after the birth of the baby, including medical errors made during a circumcision, infections or complications from receiving improper care.
